General Terms and Conditions (GTC)

§ 1 Scope, Contracting Party

(1) These General Terms and Conditions (hereinafter "GTC") apply to all orders that you place as a consumer or entrepreneur via the online shop of GETPOPSTRAPS™ at https://getpopstraps.shop.

(2) A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity (Section 13 of the German Civil Code, BGB).

(3) An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (Section 14 BGB).

(5) Deviating terms and conditions of the customer are not recognized unless we expressly agree to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. By clicking the order button, you place a binding order for the goods contained in your shopping cart.

(2) Confirmation of receipt of your order is sent immediately after you submit the order by means of an automatically generated email. This order confirmation does not yet constitute acceptance of your contract offer.

(3) The contract is concluded as soon as we accept your order through an express order confirmation by email or through the dispatch of the goods. In the case of a pre-order (see § 4), the contract is deemed concluded upon dispatch of the order confirmation.

(4) The contract text is stored by us. You can view the GTC at any time via our website. You will receive your order data by email.

(5) The contract language is German.

§ 3 Prices and Shipping Costs

(1) All prices on our website are stated in euros (EUR) and do not include value added tax due to the application of the small business regulation pursuant to Section 19(1) of the German VAT Act (§ 19 Abs. 1 UStG).

(2) For deliveries to other EU countries, to Switzerland, or to other third countries, differing tax and customs regulations may apply. In this regard, reference is made to § 6 of these GTC.

(3) In addition to the stated prices, shipping costs may apply depending on the delivery country. Shipping costs are clearly displayed to you during the ordering process before you submit your order.

(4) We reserve the right to change our prices at any time. The prices stated in the online shop at the time of your order apply.

§ 4 Pre-Order — Special Conditions for Pre-Orders

(1) Some products are offered through a pre-order process. A pre-order means that the product is not yet ready for dispatch at the time of your order, and the estimated dispatch date is indicated on the product page.

(2) In the case of a pre-order, the purchase price is due immediately upon order and is charged via the payment method you have selected. This corresponds to the usual procedure for pre-orders.

(3) We make every effort to meet the estimated dispatch date stated on the product page. However, delays cannot be ruled out within the scope of a pre-order.

(4) Right to free cancellation: You can cancel your pre-order free of charge at any time up until dispatch. An email to help@getpopstraps.shop stating your order number is sufficient. In this case, we will refund the full purchase price within fourteen days via the payment method originally used.

(5) Delay of more than 14 days: Should dispatch be delayed by more than fourteen days beyond the estimated dispatch date stated on the product page, we will inform you proactively by email. In this case, you can cancel free of charge at any time and will receive the full purchase price back within fourteen days. Your statutory right of withdrawal (see § 7) remains unaffected.

§ 5 Delivery

(1) We deliver to the following countries:

(3) For pre-orders, the delivery time stated above begins from the dispatch date indicated on the product page.

(4) The risk of accidental loss and accidental deterioration of the sold goods passes to you upon handover, where you are a consumer. In the case of entrepreneurs, the risk passes as soon as the goods are handed over to the forwarding agent, the carrier, or the person or institution otherwise designated to carry out the shipment.

§ 6 International Deliveries — Customs and Import Duties

(1) For deliveries to Switzerland and the USA, customs and import duties (e.g. value added tax, customs fees) may be charged by the authorities of the destination country. These are not included in the purchase price and are to be paid by the customer directly to the responsible authority or the shipping company.

(2) We recommend that you inform yourself about the import regulations applicable in your country before ordering. We assume no liability for the amount of any customs or import duties.

(3) For deliveries to the USA, we will work with a suitable international shipping partner. More detailed information on the shipping method and shipment tracking will be provided in the shipping confirmation.

§ 7 Right of Withdrawal for Consumers

(1) Consumers have a statutory right of withdrawal. The detailed withdrawal policy as well as a model withdrawal form can be found in our separate withdrawal policy at https://getpopstraps.shop/policies/refund-policy.

(2) The right of withdrawal expires prematurely in the case of contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (Section 312g(2)(1) BGB). This is not the case with our standard products.

§ 8 Voluntary 30-Day Money-Back Guarantee

(1) In addition to your statutory 14-day right of withdrawal, we grant you a voluntary satisfaction guarantee of 30 days from receipt of the goods.

(2) Within these 30 days, you can return the product to us without giving any reason and will receive the full purchase price refunded, provided the product is in a proper, unused condition, or has only been worn to check its nature, characteristics, and functioning.

(3) To make use of the guarantee, please contact us before returning the item at help@getpopstraps.shop with your order number.

(4) You bear the cost of return unless we make another arrangement.

(5) This voluntary guarantee in no way restricts your statutory rights arising from the right of withdrawal (§ 7 of these GTC) or from statutory liability for material defects.

§ 9 Payment

(1) We accept the following payment methods:

(2) The purchase price is due upon conclusion of the contract.

(3) In the event of late payment, we reserve the right to charge statutory default interest as well as any collection costs.

§ 10 Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

§ 11 Liability for Material Defects

(1) The statutory provisions on liability for material defects apply.

(2) In the case of defects in the delivered goods, you can demand subsequent performance within the statutory warranty period (two years from receipt of the goods). You have the choice between delivery of defect-free goods and repair.

(3) If subsequent performance fails, you can, at your choice, demand a price reduction or withdraw from the contract.

§ 12 Liability

(1) We are liable without limitation for damages arising from injury to life, body, or health based on a negligent or intentional breach of duty by us, our legal representatives, or our vicarious agents.

(2) We are liable without limitation for other damages based on a grossly negligent or intentional breach of duty by us, our legal representatives, or our vicarious agents.

(3) For other damages based on a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability is limited to the foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment characterizes the contract and on which the contracting party may rely.

(4) Otherwise, our liability is excluded.

§ 13 Online Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 14 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.

(2) Should individual provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The statutory regulation shall take the place of the invalid or unenforceable provisions.

(3) The place of performance and jurisdiction for disputes with entrepreneurs is Berlin.
